First things first, you need to search for a trademark before you set out to begin the proceedings for tm registration. A search through the trademark database will help you to figure out whether a trademark similar to what you have been looking to register exists.

After the search is complete, you can go about registering a trademark. The application for the same needs to be filed with the Trademark Registrar. The application should be duly filled and the fee paid to complete the proceedings. It should contain the following information:

  • The trademark or the logo
  • The trademark class or classification
  • A description of the services or goods
  • Name and address of the trademark owner
  • The trademark used since the date

One can also apply for a trademark online. For that, the applicant needs to provide a “Class III Digital Signature Certificate”. After the filing of the application is complete, the registrar checks the database to find out whether the trademark that has been applied for contradicts any of the existing, registered trademarks. Also, other applications that have been filed are checked for any similar request. If there are any areas of concern in the application, the registrar can check for authenticity of the same and also inform the applicant about the same. The applicant has to address the concerns of the registrar within a span of three months.

The applicant needs to then pay the fees for trademark registration. The fee for online registration is Rs. 7000. Once the trademark is achieved, the applicant can use the “R” symbol to indicate the same. This symbol has a validity period of 10 years.
